If your property is in one of Nakheel’s communities — Palm Jumeirah, Jumeirah Islands, Discovery Gardens and others — the modification-approval process runs in two stages: first approval from the management company, then an official NOC through the online portal.
The stages
STEP 1 — Approval from the Owners Association / Community Management
The first stage is getting the Scope of Work approved by the management company. The application is sent to [email protected] with the following documents:
- The contractor’s trade licence
- The owner’s Title Deed
- A detailed scope of work
- A method statement
- A risk assessment
STEP 2 — Submitting the NOC application through the online portal
Once the first stage is approved, the application is submitted through the Nakheel portal (application type — “MR: Modification to existing Apartment”). To submit, you’ll need:
- An MR undertaking letter, signed by the owner
- A contractor/consultant appointment letter, signed by the owner
- A valid trade licence for the contractor/consultant
- Third Party Liability insurance covering all risks specifically for this project
- If the property is mortgaged or leased — an NOC from the bank or leasing company
- If walls are being demolished — a set of PDF drawings showing the existing and proposed layouts
What is usually allowed and what is prohibited
Based on Nakheel’s standard approval for apartment modifications, the permitted scope of work usually includes:
- Demolishing and building new non-load-bearing internal walls in line with approved drawings
- Replacing floor and wall tiling, sanitaryware, kitchen cabinets and countertops
- Interior painting, electrical work, doors, marble finishing, ceilings and joinery
- When floor tiling is removed or replaced, the waterproofing across the entire floor area must be tested with a 48-hour pond test
Completely prohibited:
- Any works on the exterior side or balcony of the apartment
- Plumbing works above the level of the floor slab
- Core drilling (coring)
- Using heavy machinery, including jackhammers for demolition
- Removing or disturbing the floor screed
Key conditions to be aware of in advance
The NOC is tied to a specific buyer. The permit does not automatically transfer to a new owner when the property is sold — if the modification wasn’t carried out before the sale, the new buyer must reapply.
Fire-suppression systems are a separate process. An apartment-modification NOC does not cover work on sprinklers, fire pipes or the alarm system — that requires a separate NOC from Dubai Civil Defence, and any fire-suppression changes require prior approval from the management company (OA/FM).
Materials must match the existing ones. The materials used must match those already installed in the property — in their thermal and acoustic insulation properties.
Responsibility for engineering systems lies with the owner and contractor. The developer does not assess the impact of modifications on the existing MEP systems (mechanical/electrical/plumbing) or the structure — that responsibility rests entirely with the applicant and the contractor.
The NOC must be visible on site. A copy of the NOC must be displayed on the apartment’s entrance door for the whole period of the works — for inspection by the developer or authorised persons.
Insurance is mandatory. The contractor must hold valid Third-Party Liability insurance for the entire period of the works covered by the NOC.
Demolition and damage to common areas are the contractor’s responsibility. The owner and contractor are fully responsible for rectifying any damage to common areas caused during the works, at their own expense.
Technical restrictions on site
- Heavy machinery is prohibited; paint spray guns are also banned
- Core drilling in the floor is not permitted, especially in areas with existing waterproofing
- Construction debris is removed by the contractor to municipal disposal points daily — dumping into the building’s ENVAC system is strictly prohibited
- Before works begin, the building’s fire contractor must be notified to disconnect the alarm-system cables — disconnecting, cutting or rerouting these cables or sprinkler pipes yourself, without approval, is prohibited
- It’s recommended to keep the apartment’s main door closed during renovation works, to prevent humidity and odours spreading into common areas
- Any change to the appearance of balcony doors, and any tile replacement on the building’s exterior or on the balcony, must not differ in appearance from the existing finish — the façade colour scheme must remain uniform
Fees
- Apartment modification (valid 6 months) — AED 5,000
- Permit extension (every 3 months) — AED 525
- Site access permit — per worker — AED 75 per month
Important: the permit fee is charged per worker individually — if, for example, 5 people are working on site at the same time, that’s AED 375 per month in total, not a fixed sum regardless of crew size.
Consequences of non-compliance
As with other developers, breaching the NOC conditions at Nakheel ties directly to the owner’s liability: any future leaks, damage from failed waterproofing, or complaints arising from the modification are deemed the sole responsibility of the owner — not the developer, not the management company and not the contractor.
In addition:
- Inability to re-register or sell the property
- Inability to obtain the Title Deed
- Notices of violation from Nakheel and the relevant government authorities
